Terms of Use

These Terms of Use ("Terms") govern your use of the DailyGlot iOS application (the "App") and the dailyglot.com website (the "Site"), provided by Franco Molina ("we", "our", "us"). By creating an account, downloading the App, or using the Site, you agree to these Terms. If you do not agree, do not use the App or the Site.

1. The Service

DailyGlot is a language-learning application that delivers daily news stories adapted to a learner's level in French, English, or Spanish. The App provides reading, audio narration, vocabulary translation, and review features.

2. Eligibility

You must be at least thirteen years old to use DailyGlot. If you are under the age of majority in your country, you must have your parent or guardian's permission. By using the App you represent that you meet these requirements.

3. Your Account

• You are responsible for keeping your credentials secure and for all activity under your account.
• You may not share your account, sell it, or use someone else's account.
• You must provide accurate information and keep it up to date.
• We may suspend or terminate accounts that violate these Terms or pose a risk to other users or to the service.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable law.
• Attempt to reverse-engineer, decompile, or otherwise extract source code from the App, except where permitted by law.
• Use automated tools to access the App, scrape its content, or generate excessive load on its servers.
• Interfere with the operation of the App or its security.
• Resell, redistribute, or republish content from the App without our written permission.

5. Content

The articles in the App are generated by artificial intelligence based on real public news sources. We make a good-faith effort to ensure accuracy, but we make no warranty that any article is free of error, omission, or interpretation bias. Articles should not be relied upon for journalistic, professional, or legal purposes.

The text, code, design, and brand of the App are owned by DailyGlot and protected by copyright and trademark law. Saved words and personal notes you create are yours.

6. Purchases and Subscriptions

The App is currently free during its launch period. In the future we may introduce paid subscriptions. If we do:

• All purchases are processed by Apple through your Apple ID. Apple's payment terms apply.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID settings.
• Refunds are handled by Apple, not by us, in accordance with Apple's policies.
• Any trial converts to a paid subscription unless cancelled before the trial ends.

7. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that it will produce any particular learning outcome.

8. Limitation of Liability

To the maximum extent permitted by law, DailyGlot shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the App. Our total liability for any claim arising under these Terms is limited to the amount you paid us in the twelve months preceding the claim, or $50 USD if no payment was made.

9. Termination

You may delete your account at any time through Settings → Delete account. We may terminate or suspend your account if you violate these Terms. Sections relating to intellectual property, disclaimers, limitation of liability, and dispute resolution survive termination.

10. Changes to These Terms

We may revise these Terms. When we make material changes we will update the "Last updated" date and notify you in the App. Continued use after a change constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of Mexico, without regard to its conflict-of-laws provisions. Any dispute arising under these Terms will be resolved in the courts of Mexico City.

12. Apple's Required Terms

If you obtained the App from Apple's App Store, the following additional terms apply:

• These Terms are between you and DailyGlot only, not with Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance and support for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App, if any. Apple has no other warranty obligation.
• Apple is a third-party beneficiary of these Terms and may enforce them against you.
